Cooper Passes In Burke Hospital; Rites Set Today MORGANTON, Jan. 27. (Special) 57, for the past 15 years engineer at the North Carolina school for the deaf here, died Monday at Grace hospital after an illness of three weeks. Funeral services will be conducted at 2:30 o'clock Tuesday afternoon at the First Methodist church, attended in a body by students of the state school. Mr.

Cooper, known as Fate Cooper, was a native of Rutherford county and was reared near Ellenboro. Before coming here he was locomotive engineer for a short line in Rutherford and resided at Cliffside. active in prounts, Shrine circles. Surviving are his wife, the former Miss Catherine Gold of Polkville; two children, Miss Ruth Cooper and Arnold Cooper, at the home here; two brothers, J. Cooper of Shelby and Joseph L.

Mary Tate of Ellenboro. MAY EXTEND WAYNESVILLE TOWN LIMITS WAYNESVILE, Jan. 27. (Special) Aldermen of the town of Waynesville gave notice recently that a bill will be introduced at the present session of the state legislature to extend the corporate limits here SO as to take in much of the property that has been developed since the years ago. Thirty days will have to present limits, were fixed about 30 elapse after the notice is given, it was stated.

The extensions would increase the population of the town to approximately 3,500 and the property valuation several hundred thousand dollars. They would also increase the expenses of the town. 27. (Spedial; -Forty-one students at the Hot Springs high school in Madison county made the honor roll for the fourth month, according to an announcement made by Principal Grover L. Angel. MRS. BURRELL'S RITES HELD IN MACON COUNTY HIGHLANDS, Jan. 27. (Special) Funeral services for Mrs. Mark Burrell, 52, were held at the Clear Creek Baptist church Sunday morning at 11 o'clock the Rev.

J. O. Nix of Satolah, officiating. Burial was in the church cemetery. Mrs.

Burrell died at her home early Saturday morning. Her death was attributed to measles and pneumonia. She was a member of the Baptist church. Surviving are her husband, one daughter, Mrs. John Reese, and three sons.

Phoenix, 58, employe a local coal and firm, dropped dead Monday while at work. Death was attributed to a heart attack. Surviving are his widow: two children, J. B. and Mildred, and one step-son, Otis Rowe.

All are of Canton. Also surviving are two half-brothers, and Talmadge Phoenix of Gastonia. Funeral arrangements are incomplete. Wells Funeral home is in charge. Wrights Buy House At McDowell Town OLD FORT, Jan.

announced Monday. The Lions meeting last week was postponed on account of the influenza epidemic. Haywood Court Clerk Is Back In Office WAYNESVILLE, Jan. 27. (Special) W.

G. Byers, clerk of Haywood County superior court, who has spent several weeks in an Asheville hospital recuperating from two major operations, was back in his office in the courthouse here Monday morning. While away, the business of the office was carried on by Miss Kate Williamson, assistant clerk. PETAIN ASSUMES NEW POWERS IN VICHY SET -UP Long Expected Cabinet Shakeup Predicted Soon (By The Associated Press) VICHY. France, Jan. Philippe Petain's already vast powers as personal leader of France were bulwarked tonight by a new decree of allegiance which would enable him to prosecute and punish the misdeeds of ministers and other high officials of the last ten years. The retroactive feature of the new constitutional act would empower the chief of state to deal with former Premiers Edouard Daladier, Leon Blum and Paul Reynaud; ex-Ministers Pierre Cot, Georges Mandel and others now facing "war guilt" trials by the supreme court. The old constitution specifically forbade retroactive laws, and in this connection informed circles recalled that the ouster of Pierre Laval as Petain's vice-premier and foreign minister followed business actions which Petain disapproved but which later proved apparently blameless.

Petain since has conferred with Laval and announced their "misunderstandings" as dissipated. Following announcement of. the decree informed circles predicted long expected cabinet changes, including a shift in the ministry of justice, would take place soon. They said Minister of Justice Raphael Alibert would be replaced by Joseph Barthelemy, of the University of Paris Law school. Other changes forecast included: Minister of Labor Rene Belin to be replaced by two men splitting up industrial production under the categories of employer and employe; Jacques Chevalier to be replaced as minister of youth and education.

The new constitutional act will make persons and their property fully responsible for fulfilling their posts for the good of the state. "The regime of irresponsibility over." said an official commentary. "The state appears now as a hierarchy with a chief at the head who commands and must be Men who accept responsibility now stake their liberty, their goods and their lives." The act also will apply, it was announced. "to former, ministers who held office within the past ten years" and "the action taken by the chief of state will not exclude further action through legal channels." If charges against officials are supported by Petain's investigation, it was announced, he may order them to make restitution, deprive them of their political rights and put them under house surveillance, under administrative internment or detention in a "fortified enclosure." GRAND JURY CEDAR RAPIDS, Jan. 27. (P)-Verne Marshall, chairman of the No Foreign War committee, was served today with a federal subpoena directing him to appear next Thursday before a District of Columbia grand jury. IL is the second time in two wee that the former Iowa editor, said he was resting at his hothe here on advice of his physician, has been served. In the previous instance Marshall was served with a subpoena which he claimed was signed by a clerk who no longer held office.

Today, when Deputy U. S. Marshal Je Petrus brought the paper to him, Marshall demanded expenses for the round trip to Washington and Petrus gave him $83 in cash. "of course, I would not be subpoenaed before a federal grand jury at Washington but for the fact am of the No Foreign War committee Marshall said in a statement. "The purpose of whoever directed issuance of that subpoena may be to embarrass, humiliate and, possibly, silence our committee and its chairman." (UP)-A naval reserve armory here was destroyed by fire today. The blaze apparently started in the furnace room the building but two agents of the federal bureau of investigation and a police sabotage squad were assigned to investigate.
